Azerba\u00efdjan (no 10226\/13)<\/span><\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Le requ\u00e9rant, Ramazan Tershiyev, est un ressortissant russe d\u2019ethnie tch\u00e9tch\u00e8ne n\u00e9 en 1961.<\/span> <span style=\"color: #000000;\">L\u2019affaire concernait la menace de son extradition en Russie.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Arriv\u00e9 en Azerba\u00efdjan en 2009, il y fut d\u00e9clar\u00e9 coupable, en avril 2011, de plusieurs infractions graves <\/span><span style=\"color: #000000;\">commises dans le pays, notamment de la cr\u00e9ation d\u2019un groupe arm\u00e9 organis\u00e9 ill\u00e9gal et de <\/span><span style=\"color: #000000;\">l\u2019\u00e9tablissement \u00e0 Bakou d\u2019un r\u00e9seau d\u2019appartements clandestins destin\u00e9s \u00e0 h\u00e9berger des membres <\/span><span style=\"color: #000000;\">de groupes arm\u00e9s ill\u00e9gaux op\u00e9rant en Tch\u00e9tch\u00e9nie. Il fut condamn\u00e9 \u00e0 14 ann\u00e9es d\u2019emprisonnement, <\/span><span style=\"color: #000000;\">peine qu\u2019il purge actuellement en Azerba\u00efdjan.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">En septembre 2011, une proc\u00e9dure p\u00e9nale fut ouverte \u00e0 son encontre en Russie pour appartenance <\/span><span style=\"color: #000000;\">\u00e0 un groupe arm\u00e9 ill\u00e9gal op\u00e9rant en Tch\u00e9tch\u00e9nie. En 2012, cette proc\u00e9dure aboutit \u00e0 sa mise en<\/span><span style=\"color: #000000;\"> accusation. Les autorit\u00e9s russes \u00e9mirent un mandat de recherche international contre lui. En<\/span><span style=\"color: #000000;\"> novembre 2012, le procureur g\u00e9n\u00e9ral adjoint azerba\u00efdjanais, faisant droit \u00e0 une demande des<\/span><span style=\"color: #000000;\"> autorit\u00e9s russes, ordonna son \u00ab extradition temporaire \u00bb en Russie pour trois mois aux fins de la prise des mesures n\u00e9cessaires dans le cadre de la proc\u00e9dure p\u00e9nale dirig\u00e9e contre lui dans ce pays. <\/span><span style=\"color: #000000;\">Le requ\u00e9rant introduisit contre cette d\u00e9cision d\u2019extradition un recours qui fut rejet\u00e9 par les juges<\/span><span style=\"color: #000000;\"> azerba\u00efdjanais. Ceux-ci not\u00e8rent en particulier que la demande d\u2019asile que l\u2019int\u00e9ress\u00e9 avait introduite<\/span><span style=\"color: #000000;\"> devant le bureau de Bakou du Haut-Commissariat des Nations Unies aux r\u00e9fugi\u00e9s (HCR) avait \u00e9t\u00e9<\/span><span style=\"color: #000000;\"> rejet\u00e9e. Ils ne tinrent pas compte du fait qu\u2019il avait fait appel de cette d\u00e9cision de rejet et que <\/span><span style=\"color: #000000;\">l\u2019examen de cet appel \u00e9tait encore en cours. En f\u00e9vrier 2013, la Cour europ\u00e9enne des droits de<\/span><span style=\"color: #000000;\"> l\u2019homme a indiqu\u00e9 au gouvernement azerba\u00efdjanais, en vertu de l\u2019article 39 de son r\u00e8glement<\/span><span style=\"color: #000000;\"> (mesures provisoires), qu\u2019il y avait lieu de surseoir \u00e0 l\u2019ex\u00e9cution de l\u2019extradition pendant la dur\u00e9e de <\/span><span style=\"color: #000000;\">la proc\u00e9dure men\u00e9e \u00e0 Strasbourg.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Invoquant en substance l\u2019article 3 (interdiction de la torture et des traitements inhumains ou<\/span><span style=\"color: #000000;\"> d\u00e9gradants) seul et combin\u00e9 avec l\u2019article 13 (droit \u00e0 un recours effectif), le requ\u00e9rant soutenait <\/span><span style=\"color: #000000;\">qu\u2019une extradition en Russie l\u2019exposerait \u00e0 un risque r\u00e9el de torture et qu\u2019il ne disposait en <\/span><span style=\"color: #000000;\">Azerba\u00efdjan d\u2019aucun recours effectif lui permettant de contester la d\u00e9cision d\u2019extradition.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong>Non-violation de l\u2019article 3<\/strong> \u2013 si la d\u00e9cision d\u2019extradition du requ\u00e9rant vers la Russie \u00e9tait mise \u00e0 <\/span><span style=\"color: #000000;\">ex\u00e9cution<\/span><br \/>\n<span style=\"color: #000000;\">Violation de l\u2019article 13 combin\u00e9 avec l\u2019article 3<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong>Mesure provisoire<\/strong> (article 39 du r\u00e8glement de la Cour) \u2013 ne pas extrader le requ\u00e9rant \u2013 en vigueur <\/span><span style=\"color: #000000;\">jusqu\u2019\u00e0 ce que l\u2019arr\u00eat devienne d\u00e9finitif ou qu\u2019une nouvelle d\u00e9cision soit rendue par la Cour.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\"><strong>Satisfaction \u00e9quitable :<\/strong> Estimant que le constat de violation constituait en soi une satisfaction <\/span><span style=\"color: #000000;\">\u00e9quitable pour le dommage moral subi par le requ\u00e9rant, la Cour a rejet\u00e9 sa demande \u00e0 ce titre.<\/span><\/p>\n<p>Views: 2<\/p>","protected":false},"excerpt":{"rendered":"<p>Le cas de la CEDH dans les affaires &#8220;Tershiyev c.
