Bir ki\u015finin m\u00fclteci olmas\u0131 i\u00e7in gereken birinci unsur yabanc\u0131 olmas\u0131, ikinci unsur ise hakl\u0131 bir nedenden \u00f6t\u00fcr\u00fc bask\u0131 ve zulme u\u011framaktan korkmas\u0131d\u0131r.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><strong>1. Yabanc\u0131 Olma Ko\u015fulu<span> <\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><strong> <\/strong><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">Bir ki\u015finin m\u00fclteci olabilmesi i\u00e7in gereken unsurlardan bir tanesi yabanc\u0131 olmas\u0131, aliange durumu yani \u00fclkesi d\u0131\u015f\u0131nda bulunmas\u0131d\u0131r. \u00dclkesi d\u0131\u015f\u0131nda bulunmaktan yani yabanc\u0131l\u0131ktan anla\u015f\u0131lmas\u0131 gereken, men\u015fe \u00fclkesi s\u0131n\u0131rlar\u0131 d\u0131\u015f\u0131na \u00e7\u0131km\u0131\u015f olmakt\u0131r.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\u00dclke d\u0131\u015f\u0131nda bulunma hali, hakl\u0131 neden ortaya \u00e7\u0131kt\u0131ktan sonra olmas\u0131 gerekmekle birlikte, daha \u00f6nce men\u015fe \u00fclkesi d\u0131\u015f\u0131nda bulunan bir ki\u015finin \u00fclke d\u0131\u015f\u0131ndaki mevcudiyeti hakl\u0131 neden \u00e7\u0131kt\u0131\u011f\u0131nda devam ediyor ise bu ki\u015fi hakl\u0131 nedenin ortaya \u00e7\u0131kt\u0131\u011f\u0131 andan itibaren yabanc\u0131l\u0131k ko\u015fuluna sahip demektir. Hatta \u00fclkesinden ayr\u0131ld\u0131\u011f\u0131 s\u0131rada m\u00fclteci olmayan, ancak yurtd\u0131\u015f\u0131nda iken m\u00fclteci stat\u00fcs\u00fcne giren ki\u015filer Mahallinde(Yerinde) M\u00fclteci \u015feklinde tan\u0131mlan\u0131rlar.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\n<p class=\"MsoNormal\" style=\"text-align: justify;\">Bir ki\u015finin birden \u00e7ok vatanda\u015fl\u0131\u011f\u0131 bulunmas\u0131 halinde yabanc\u0131l\u0131k unsuru her iki \u00fclke a\u00e7\u0131s\u0131ndan da de\u011ferlendirilmelidir. Yani, birden fazla vatanda\u015fl\u0131\u011f\u0131 olan bir ki\u015finin, vatanda\u015fl\u0131\u011f\u0131n\u0131 ta\u015f\u0131d\u0131\u011f\u0131 \u00fclkelerin her birinin korumas\u0131ndan yoksun olmas\u0131 gerekmektedir. B\u00f6yle bir durumda salt vatanda\u015fl\u0131k koruma sa\u011flamayacakt\u0131r, \u00f6ncelikle himaye i\u00e7in talepte bulunulmas\u0131 ve himaye talebinin geri \u00e7evrilip \u00e7evrilmedi\u011fi dikkate al\u0131nmal\u0131d\u0131r. E\u011fer birden fazla vatanda\u015fl\u0131\u011f\u0131 olan ki\u015finin himaye talepleri vatanda\u015fl\u0131k ba\u011f\u0131n\u0131n oldu\u011fu t\u00fcm \u00fclkelerce reddedilmi\u015fse, o ki\u015fi art\u0131k m\u00fcltecilik i\u00e7in gereken unsurlardan yabanc\u0131l\u0131k unsuruna sahip hale gelmi\u015ftir.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\n<p class=\"MsoNormal\" style=\"text-align: justify;\">Vatans\u0131z bir ki\u015finin, s\u00f6zle\u015fmede belirtilen sebeplerle ikamet etti\u011fi \u00fclkeyi terk etmesi halinde, bu \u00fclkeye d\u00f6nmesi ve korumas\u0131ndan yararlanmas\u0131 m\u00fcmk\u00fcn de\u011fildir. \u00c7\u00fcnk\u00fc, vatans\u0131z ki\u015finin ikamet etti\u011fi \u00fclkenin kendi vatanda\u015f\u0131 olmayan bir ki\u015fiye kar\u015f\u0131 bu tip bir koruma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc yoktur. Vatans\u0131z ki\u015filerle ilgili m\u00fcltecilik durumunun tespitinde, 1951 Tarihli M\u00fcltecilerin Hukuki Stat\u00fcs\u00fcne Dair Cenevre S\u00f6zle\u015fmesi\u2019 nin 1.maddesinin A f\u0131kras\u0131n\u0131n 2 numaral\u0131 bendinde belirtildi\u011fi \u00fczere vatans\u0131z ki\u015finin ikamet etti\u011fi \u00fclkenin d\u0131\u015f\u0131nda bulunmas\u0131 durumu dikkate al\u0131n\u0131r.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><strong>2.<span> <\/span>Korku, Bask\u0131-Zul\u00fcm, Bask\u0131 ve Zulme Temel Te\u015fkil Eden Nedenler, Di\u011fer Nedenler<\/strong><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><strong> <\/strong><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">Bir ki\u015finin m\u00fclteci olup olmad\u0131\u011f\u0131n\u0131n sa\u011fl\u0131kl\u0131 bir \u015fekilde de\u011ferlendirilebilmesi i\u00e7in, 1951 Tarihli M\u00fcltecilerin Hukuksal Stat\u00fcs\u00fcne Dair Cenevre S\u00f6zle\u015fmesi\u2019 nin 1.maddesinde m\u00fcltecinin tan\u0131m\u0131 verilirken kullan\u0131lan hakl\u0131 nedene dayanan korku, bask\u0131-zul\u00fcm ve di\u011fer nedenlerin a\u00e7\u0131klanmas\u0131 gerekmektedir.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><strong>2.1. Korku<\/strong><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><strong> <\/strong><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\u201cBir tehlike veya tehlike d\u00fc\u015f\u00fcncesi kar\u015f\u0131s\u0131nda duyulan kayg\u0131, \u00fcz\u00fcnt\u00fc\u201d \u015feklinde bir s\u00f6zl\u00fck anlam\u0131na sahip olan korku, 1951 Tarihli M\u00fcltecilerin Hukuki Stat\u00fcs\u00fcne Dair S\u00f6zle\u015fme\u2019 de bir ki\u015finin m\u00fclteci olup olmad\u0131\u011f\u0131n\u0131n de\u011ferlendirilmesinde kriter olarak kabul edilmi\u015ftir. Tabii ki burada ama\u00e7lanan ki\u015finin duygusal reaksiyonlar\u0131n\u0131n incelenmesi de\u011fil, tehdit veya tehlike durumunun de\u011ferlendirilmeye tabi tutulmas\u0131d\u0131r.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\n<p class=\"MsoNormal\" style=\"text-align: justify;\">S\u00f6zle\u015fmede yer alan \u201czulme u\u011framaktan hakl\u0131 nedenle korkma\u201d ifadesi ile k\u0131tl\u0131k, do\u011fal afet gibi \u00e7ok say\u0131da insan\u0131 etkileyen olaylar sonucu \u00fclkesini terk edenlerin m\u00fclteci stat\u00fcs\u00fcne girmeleri engellenmi\u015ftir.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\n<p class=\"MsoNormal\" style=\"text-align: justify;\">Birle\u015fmi\u015f Milletler M\u00fclteciler Y\u00fcksek Komiserli\u011fi taraf\u0131ndan haz\u0131rlanan M\u00fclteci Stat\u00fcs\u00fcn\u00fcn Tayininde Uygulanacak \u00d6l\u00e7\u00fct ve Usuller Hakk\u0131nda El Kitab\u0131\u2019 nda ise korku, geni\u015f olarak yorumlanm\u0131\u015ft\u0131r. El kitab\u0131nda, ki\u015finin karakterinin, ge\u00e7mi\u015finin, sosyal durumunun vb unsurlar\u0131n da g\u00f6z \u00f6n\u00fcne al\u0131nmas\u0131 gerekti\u011fi ifade edilmi\u015ftir.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><strong>2.2. Bask\u0131 ve Zul\u00fcm<\/strong><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><strong> <\/strong><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\u0130ngilizcesi \u201cPersecution\u201d olan kelime T\u00fcrk\u00e7e\u2019 ye zul\u00fcm olarak terc\u00fcme edilmi\u015f olup, s\u00f6zl\u00fck anlam\u0131 haks\u0131zl\u0131k, eziyet ve cefa\u2019 d\u0131r.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\n<p class=\"MsoNormal\" style=\"text-align: justify;\">1951 Tarihli M\u00fcltecilerin Hukuki Stat\u00fcs\u00fcne Dair Cenevre S\u00f6zle\u015fmesi\u2019 nin haz\u0131rland\u0131\u011f\u0131 d\u00f6nemde zul\u00fcm kavram\u0131n\u0131n kapsam\u0131na girebilecek b\u00fct\u00fcn olgu ve olaylar\u0131n s\u00f6zle\u015fmede tek tek say\u0131lmas\u0131n\u0131n pratik imkans\u0131zl\u0131\u011f\u0131 sebebiyle, esnek bir kavram olarak d\u00fc\u015f\u00fcn\u00fclen \u201czul\u00fcm\u201d kavram\u0131 tercih edilmi\u015ftir.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\n<p class=\"MsoNormal\" style=\"text-align: justify;\">Literat\u00fcrde bug\u00fcn dahi kelimenin tan\u0131m\u0131 ve kapsam\u0131 konusunda tam olarak bir mutabakat sa\u011flanabilmi\u015f de\u011fildir. Ancak genel olarak literat\u00fcrde zul\u00fcm geni\u015f bir i\u00e7erikle yorumlanmaktad\u0131r ve insan onuruyla ba\u011fda\u015fmayacak t\u00fcm eylemler zul\u00fcm olarak nitelendirilmektedir.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\n<p class=\"MsoNormal\" style=\"text-align: justify;\">M\u00fclteci Stat\u00fcs\u00fcn\u00fcn Tayininde Uygulanacak \u00d6l\u00e7\u00fct ve Usuller Hakk\u0131nda El Kitab\u0131\u2019 nda da zul\u00fcm kavram\u0131 tan\u0131mlanmam\u0131\u015f, ancak 1951 Tarihli M\u00fcltecilerin Hukuki Stat\u00fcs\u00fcne Dair Cenevre S\u00f6zle\u015fmesi\u2019 nin 33.maddesine at\u0131f yap\u0131larak \u0131rk, din, milliyet, siyasal d\u00fc\u015f\u00fcnceler ya da belirli sosyal gruplara mensubiyet nedeniyle ya\u015fam ve \u00f6zg\u00fcrl\u00fc\u011f\u00fcn tehdit alt\u0131nda bulunmas\u0131 hali ile insan haklar\u0131n\u0131n ciddi bi\u00e7imde ihlal edildi\u011fi durumlar zul\u00fcm olarak nitelendirilmi\u015ftir.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\n<p class=\"MsoNormal\" style=\"text-align: justify;\">Baz\u0131 \u00fclkelerin uygulamalar\u0131 ve mahkeme kararlar\u0131nda; bizzat kendi \u00fclke makamlar\u0131 taraf\u0131ndan veya bunlar\u0131n bilgisi dahilinde kendilerine ruhsal veya fiziksel a\u00e7\u0131dan zarar verecek devaml\u0131 ve sistemli bir eziyet, eza ve cefa uygulanan; dolay\u0131s\u0131yla \u00fclkesinden koruma talep edemeyen ve ba\u015fka bir \u00fclkeye ka\u00e7mak zorunda kalan ki\u015filerin zul\u00fcm i\u00e7erisinde olduklar\u0131n\u0131n kabul edildi\u011fi g\u00f6r\u00fclmektedir.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><strong>2.3. Bask\u0131 ve Zulme Temel Te\u015fkil Eden Nedenler <\/strong><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><strong> <\/strong><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">Bask\u0131 ve zul\u00fcm te\u015fkil eden nedenler; 1951 Tarihli M\u00fcltecilerin Hukuki Stat\u00fcs\u00fcne Dair Cenevre S\u00f6zle\u015fmesi\u2019 nin 1.maddesinin A f\u0131kras\u0131n\u0131n 2 numaral\u0131 bendinde; \u0131rk, din, milliyet, belirli bir sosyal gruba mensubiyet ve siyasi d\u00fc\u015f\u00fcnce \u015feklinde tek tek say\u0131lmak suretiyle g\u00f6sterilen ki\u015fisel ve siyasal nedenlerdir.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><strong>2.3.1. Irk<\/strong><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><strong> <\/strong><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">Irk ayr\u0131mc\u0131l\u0131\u011f\u0131 zulm\u00fc kan\u0131tlamada en \u00f6nemli unsurlardan birisidir. Ancak takdir edilmelidir ki, bir ki\u015finin belli bir \u0131rka mensubiyeti, m\u00fclteci olmas\u0131 i\u00e7in tek ba\u015f\u0131na yeterli bir fakt\u00f6r olarak de\u011ferlendirilemez. Ki\u015finin belli bir \u0131rka mensup olmas\u0131 sebebiyle zulme ya da bask\u0131ya maruz kalmas\u0131 halinde m\u00fcltecilik stat\u00fcs\u00fc kazan\u0131lmaktad\u0131r.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\n<p class=\"MsoNormal\" style=\"text-align: justify;\">1951 Tarihli M\u00fcltecilerin Hukuki Stat\u00fcs\u00fcne Dair Cenevre S\u00f6zle\u015fmesi\u2019 nde \u0131rk kavramsal olarak ve i\u00e7erik a\u00e7\u0131s\u0131ndan tan\u0131mlanmam\u0131\u015fsa da burada ifade edilen \u0131rk kavram\u0131n\u0131n yaln\u0131zca siyah, beyaz gibi klasik ve bilimsel kategori i\u00e7erisinde yer almakta olan etnik gruplar\u0131 de\u011fil, fiziksel ve k\u00fclt\u00fcrel farkl\u0131l\u0131klar\u0131 olan di\u011fer gruplar\u0131 da kapsad\u0131\u011f\u0131n\u0131 ifade etmeliyiz. Fiziksel ve k\u00fclt\u00fcrel farkl\u0131l\u0131klar\u0131 olan gruplara Yahudiler, \u00c7erkesler gibi \u00f6rnekler verebiliriz.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><strong>2.3.2. Milliyet-Uyrukluk<\/strong><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><strong> <\/strong><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">1951 Tarihli M\u00fcltecilerin Hukuki Stat\u00fcs\u00fcne Dair S\u00f6zle\u015fme metninde yer alan milliyet-uyrukluk kavram\u0131, hukuki tabiyet, vatanda\u015fl\u0131k \u015feklinde yorumlanmamal\u0131d\u0131r. T\u0131pk\u0131 \u0131rk kavram\u0131 gibi milliyet-uyrukluk kavram\u0131 da 1951 Tarihli M\u00fcltecilerin Hukuki Stat\u00fcs\u00fcne Dair Cenevre S\u00f6zle\u015fmesi\u2019 nde tan\u0131mlanmam\u0131\u015fsa da literat\u00fcrde bu konuda \u00e7e\u015fitli g\u00f6r\u00fc\u015fler ileri s\u00fcr\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\n<p class=\"MsoNormal\" style=\"text-align: justify;\">Gerek M\u00fclteci Stat\u00fcs\u00fcn\u00fcn Tayininde Uygulanacak \u00d6l\u00e7\u00fct ve Usuller Hakk\u0131nda El Kitab\u0131\u2019 nda, gerekse 1951 Tarihli M\u00fcltecilerin Hukuki Stat\u00fcs\u00fcne Dair Cenevre S\u00f6zle\u015fmesi\u2019 nde yer alan \u201cmilliyet-uyrukluk\u201d kavram\u0131, belirli bir etnik, k\u00fclt\u00fcrel grup yada dil grubuna mensup olma \u015feklinde yorumlanmakta, ayr\u0131ca kavram\u0131n \u201c\u0131rk\u201d kavram\u0131 ile e\u015f anlaml\u0131 oldu\u011fu vurgulanmaktad\u0131r.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><strong>2.3.3. Din<\/strong><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><strong> <\/strong><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">Din ve ibadet \u00f6zg\u00fcrl\u00fc\u011f\u00fc temel insani haklardand\u0131r. Din ve dinsel ibadetlerin yerine getirilmesi ki\u015fisel bir tercih olup devletler, resmi g\u00f6revliler ya da \u00e7e\u015fitli kurulu\u015flar ki\u015fileri bu konularda zorlama hakk\u0131na sahip de\u011fildir.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\n<p class=\"MsoNormal\" style=\"text-align: justify;\">Bir ki\u015finin \u201cdin ve ibadet\u201d unsurunu ileri s\u00fcrerek m\u00fclteci olabilmesi i\u00e7in, bu talepte bulunan ki\u015finin dini inanc\u0131 ya da inan\u00e7s\u0131zl\u0131\u011f\u0131 ile bask\u0131-zul\u00fcm aras\u0131nda bir ba\u011f bulunmas\u0131 ve talebin hakl\u0131 bir nedene dayanmas\u0131 gerekmektedir.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><strong> <\/strong><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><strong>2.3.4. Siyasi D\u00fc\u015f\u00fcnce<\/strong><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><strong> <\/strong><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">Bir ki\u015finin siyasi d\u00fc\u015f\u00fcncesinden \u00f6t\u00fcr\u00fc m\u00fclteci stat\u00fcs\u00fcne kabul edilebilmesi i\u00e7in bir tak\u0131m ko\u015fullar\u0131n varl\u0131\u011f\u0131 gerekmektedir. Belirli Bir Sosyal Gruba Mensup Olma<\/strong><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span> <\/span><span> <\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">Belirli bir sosyal grupta anla\u015f\u0131lmas\u0131 gereken, ayn\u0131 k\u00f6kenden olan, ayn\u0131 ya\u015fam bi\u00e7imini s\u00fcrd\u00fcren veya ayn\u0131 sosyal stat\u00fcye sahip olan ki\u015filer birlikteli\u011fidir.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\n<p class=\"MsoNormal\" style=\"text-align: justify;\">Literat\u00fcrde, \u201cBelirli Bir Soysa Gruba Mensubiyet\u201d genelde \u00fc\u00e7 farl\u0131 kategoride de\u011ferlendirilir. Bu kategorilerden birincisi cins, renk ve akrabal\u0131k gibi do\u011fu\u015ftan gelen ve de\u011fi\u015ftirilmesi olanaks\u0131z olanlardan olu\u015furken; ikinci kategoriyi ki\u015finin kendi iradesi ile ge\u00e7mi\u015finde kazand\u0131\u011f\u0131, lakin istese dahi art\u0131k terk edemeyece\u011fi \u00f6zellikler; \u00fc\u00e7\u00fcnc\u00fc kategoriyi ise iradi olarak belirlenen insan haysiyeti ile ilgili olanlar olu\u015fturmaktad\u0131r.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\u201cBelirli bir sosyal gruba mensup olma\u201d kavram\u0131 aileyi, dernekler ve \u00e7e\u015fitli g\u00f6n\u00fcll\u00fc kurulu\u015flar\u0131 ve s\u0131n\u0131flar\u0131 da kapsamaktad\u0131r. Ancak ki\u015finin m\u00fcltecilik talebinde bulunabilmesi i\u00e7in belli bir s\u0131n\u0131fa, aileye, derne\u011fe vb. mensup olmas\u0131 yeterli de\u011fildir, bu s\u0131n\u0131fa, aileye, derne\u011fe vb. mensup oldu\u011fu i\u00e7in bask\u0131 ve zul\u00fcm korkusu i\u00e7erisinde olmas\u0131 gerekmektedir.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><strong>2.4. Di\u011fer Nedenler<\/strong><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><strong> <\/strong><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">1951 Tarihli M\u00fcltecilerin Hukuki Stat\u00fcs\u00fcne Dair Cenevre S\u00f6zle\u015fmesi\u2019 ne g\u00f6re bir ki\u015finin m\u00fclteci stat\u00fcs\u00fc alabilmesi i\u00e7in ki\u015fisel ve siyasi nedenlerin varl\u0131\u011f\u0131ndan bahsettik. Peki bu belirli nedenler d\u0131\u015f\u0131nda ki\u015finin su\u00e7 olu\u015fturan eylemleri, askerlik hizmetleri gibi \u00f6zel durumlar\u0131 m\u00fclteci stat\u00fcs\u00fc elde etmesine imkan tan\u0131makta m\u0131d\u0131r? Bu konuyla ilintili olarak literat\u00fcrdeki bilgileri ve uygulamadaki olaylar\u0131 inceledi\u011fimizde b\u00f6ylesi \u00f6zel nedenlerin kabul edilebilmesi i\u00e7in hakl\u0131 nedene dayal\u0131 bask\u0131 ve zul\u00fcm korkusunun ortaya \u00e7\u0131km\u0131\u015f olmas\u0131 \u015fart\u0131n\u0131n arand\u0131\u011f\u0131 g\u00f6r\u00fclmektedir.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><strong>2.4.1. Adi ve Siyasi Su\u00e7larla \u0130li\u015fkili Nedenler<\/strong><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><strong> <\/strong><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">M\u00fclteci Stat\u00fcs\u00fcn\u00fcn Tayininde Uygulanacak \u00d6l\u00e7\u00fct ve Usuller Hakk\u0131nda El Kitab\u0131\u2019 nda m\u00fclteci, \u201cadalet ka\u00e7a\u011f\u0131 de\u011fil, adaletsizli\u011fin kurban\u0131 olan ki\u015fi\u201d \u015feklinde betimlenmi\u015ftir. Bu sebepledir ki, adi su\u00e7tan h\u00fck\u00fcm giymi\u015f bir ki\u015finin m\u00fclteci stat\u00fcs\u00fc elde edememesi gerekmektedir. \u00d6te yandan, a\u011f\u0131r cezay\u0131 gerektiren su\u00e7lar da ki\u015fiyi m\u00fclteci stat\u00fcs\u00fc kapsam\u0131 d\u0131\u015f\u0131nda b\u0131rak\u0131r.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\n<p class=\"MsoNormal\" style=\"text-align: justify;\">Siyasi bir su\u00e7 nedeniyle hakk\u0131nda kovu\u015fturma yap\u0131lan bir ki\u015finin durumu de\u011ferlendirilirken ise, bu kovu\u015fturman\u0131n sadece siyasi bir d\u00fc\u015f\u00fcnceden mi ba\u015flat\u0131ld\u0131\u011f\u0131, yoksa yasalarda cezay\u0131 gerektiren siyasi ama\u00e7lara y\u00f6nelik su\u00e7 say\u0131lan bir eylemden mi kaynakland\u0131\u011f\u0131n\u0131n dikkate al\u0131nmas\u0131 gerekmektedir. E\u011fer ki\u015fi hakk\u0131nda yap\u0131lan adli i\u015flemler \u00fclkenin genel hukuk d\u00fczenine uygun ise, ba\u015fvuruda bulunan ki\u015fi m\u00fclteci stat\u00fcs\u00fcne al\u0131nmayacakt\u0131r. Ancak, i\u015fledi\u011fi su\u00e7 i\u00e7in yasada \u00f6ng\u00f6r\u00fclen cezadan farkl\u0131 olarak a\u015f\u0131r\u0131 ve keyfi \u015fekilde bir cezaland\u0131rma s\u00f6z konusu ise bu durum zul\u00fcm olarak nitelendirilecek ve ki\u015finin zulme u\u011framaktan korktu\u011funun kabul\u00fc ile ba\u015fvuru sahibi m\u00fclteci stat\u00fcs\u00fcn\u00fc elde edecektir.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\n<p class=\"MsoNormal\" style=\"text-align: justify;\">Siyasi su\u00e7lara ili\u015fkin b\u00f6l\u00fcmde anlat\u0131ld\u0131\u011f\u0131 \u00fczere, adi bir su\u00e7tan \u00f6t\u00fcr\u00fc ki\u015fiye verilen ceza bir a\u015f\u0131r\u0131l\u0131k te\u015fkil ediyorsa, bu durumun zul\u00fcm olarak nitelenerek genel kurala istisna te\u015fkil etmesi ka\u00e7\u0131n\u0131lmazd\u0131r.<\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\">\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><strong>2.4.2.
