The applicants alleged that their relatives disappeared after being  abducted by Russian servicemen and that the domestic authorities failed  to carry out an effective investigation into their allegations. They  relied in particular on Articles\u00a02 (right to life), 3 (prohibition of  inhuman or degrading treatment), 5 (right to liberty and security) and\u00a013  (right to an effective remedy) of the European Convention on Human Rights.<\/span><\/p>\n<p class=\"Normal\" style=\"margin-top: 24pt; text-align: justify;\"><span style=\"color: #000000;\">1.\u00a0<span class=\"Normal--Char\" style=\"font-weight: bold; font-style: italic; text-decoration: underline;\">Dzhambekova and Others  v. Russia<\/span><span class=\"Normal--Char\" style=\"font-weight: bold; font-style: italic;\"> <\/span>(nos. 27238\/03 and 35078\/04)<\/span><\/p>\n<p class=\"Normal\" style=\"margin-top: 12pt; text-align: justify;\"><span style=\"color: #000000;\">The applicants in the first  case are 19 Russian nationals belonging to four families who live in  the Urus-Martan district (<a name=\"HIT1\"><\/a>Chechen Republic). They are the close relatives  of Imran Dzhambekov, Magomed Soltymuradov, Rizvan Tatatariyev and Sharpudi  Visaitov, born in 1979, 1969, 1977 and 1980, respectively. The four  men have not been seen since they were abducted from their family homes  in late 2001 and early 2002 by armed, masked men in camouflage uniforms.  Since then the four families have been conducting a search for the four  men together. In December 2002 Imran Dzhambekov\u2019s mother and Magomed  Soltymuradov\u2019s sister, at a \u201ccongress of the <a name=\"HIT2\"><\/a>Chechen people\u201d in  order to draw attention to their relatives\u2019 disappearance, were arrested  and detained for four days at Gudermes District Department of the Interior. In respect  of non-pecuniary damage, the Court awarded EUR\u00a035,000 to Imran Dzhambekov\u2019s  parents, sister and brother; EUR\u00a035,000 to Magomed Soltymuradov\u2019s sisters,  children, uncle, cousin and wife; EUR\u00a035,000 to Rizvan Tatatariyev\u2019s  mother, daughter, sister and wife; EUR\u00a035,000 to Sharpudi Visaitov\u2019s  parents; and, EUR\u00a010,000, each, to Imran Dzhambekov\u2019s mother and oldest  sister. Russia<\/span><span class=\"Normal--Char\" style=\"font-weight: bold; font-style: italic;\"> <\/span>(no. 21816\/03)<\/span><\/p>\n<p class=\"Normal\" style=\"margin-top: 12pt; text-align: justify;\"><span style=\"color: #000000;\">The applicants in the second  case are eight Russian nationals who live in Tsotsi-Yurt (<a name=\"HIT3\"><\/a>Chechen Republic).  They are the close relatives of Salakh Elsiyev, Iskhadzhi Demelkhanov,  Akhmed Demilkhanov, Adam Boltiyev, Dzhabrail Debishev, Lom-Ali Abubakarov,  Ramzan Mandiyev and Aslambek Agmerzayev, born in 1972, 1980, 1984, 1980,  1977, 1968, 1981 and 1956, respectively. The eight men have not been  seen since 2\u00a0and\u00a03\u00a0September 2002 when they were abducted from their family  homes by armed men in camouflage uniforms, some wearing masks. Russia<\/span><span class=\"Normal--Char\" style=\"font-weight: bold; font-style: italic;\"> <\/span>(no. 5351\/04)<\/span><\/p>\n<p class=\"Normal\" style=\"margin-top: 12pt; text-align: justify;\"><span style=\"color: #000000;\">The applicants in the third  case are eight Russian nationals who live in Urus-Martan (<a name=\"HIT4\"><\/a>Chechen Republic).  They are the close relatives of Ali Zainievich Khadayev, born in 1977,  who was abducted from his family home in the early hours of 5\u00a0January  2003 by a group of armed men wearing camouflage uniforms.<\/span><\/p>\n<p class=\"Normal\" style=\"margin-top: 12pt; text-align: justify;\"><span style=\"color: #000000;\"><span class=\"Normal--Char\" style=\"font-weight: bold;\">Violations of Article 2 (right to life and lack of effective investigation)<\/span><\/span><\/p>\n<p class=\"Normal\" style=\"text-align: justify;\"><span style=\"color: #000000;\"><span class=\"Normal--Char\" style=\"font-weight: bold;\">Violation of Article 3 (inhuman treatment in respect of the applicants)<\/span><\/span><\/p>\n<p class=\"Normal\" style=\"text-align: justify;\"><span style=\"color: #000000;\"><span class=\"Normal--Char\" style=\"font-weight: bold;\">Violation of Article 5 (unacknowledged detention)<\/span><\/span><\/p>\n<p class=\"Normal\" style=\"text-align: justify;\"><span style=\"color: #000000;\"><span class=\"Normal--Char\" style=\"font-weight: bold;\">Violation of Article 13 (lack of an effective remedy) in conjunction  with Article 2<\/span><\/span><\/p>\n<p class=\"Normal\" style=\"margin-top: 12pt; text-align: justify;\"><span style=\"color: #000000;\">The Court awarded EUR\u00a04,000  to Ali Khadayev\u2019s father in respect of pecuniary damage, EUR\u00a035,000  to the applicants, jointly, in respect of non-pecuniary damage, and  EUR\u00a07,000 for costs and expenses. <\/span><\/p>\n<p class=\"Normal\" style=\"margin-top: 12pt; text-align: justify;\"><span style=\"color: #000000;\">*********<\/span><\/p>\n<p class=\"Normal\" style=\"margin-top: 12pt; text-align: justify;\"><span style=\"color: #000000;\"><span class=\"Normal--Char\" style=\"font-weight: bold;\">Additional information concerning the Court\u2019s findings in these  cases<\/span><a style=\"text-decoration: none;\" href=\"http:\/\/cmiskp.echr.coe.int\/tkp197\/viewhbkm.asp?sessionId=23422951&amp;skin=hudoc-pr-en&amp;action=html&amp;table=F69A27FD8FB86142BF01C1166DEA398649&amp;key=44997&amp;highlight=chechen#02000002\"><span class=\"Footnote-0020Reference--Char\"><\/span><\/a><\/span><\/p>\n<p class=\"Normal\" style=\"margin-top: 12pt; text-align: justify;\"><span style=\"color: #000000;\">In all three cases the  Court considered that the applicants had presented a coherent and convincing  picture of their relatives\u2019 abduction, corroborated by witness statements.  In the case of <span class=\"Normal--Char\" style=\"font-weight: bold; font-style: italic;\">Elsiyev and Others<\/span> it was indeed even common  ground between the parties that the applicants\u2019 eight relatives had  been apprehended in a security operation in Tsotsi-Yurt. The Court therefore  held in all three cases that the evidence available to it established  beyond reasonable doubt that the applicants\u2019 relatives had to be presumed  dead following their unacknowledged detention by Russian servicemen  during security operations. The Court came to these conclusions by drawing  inferences from the Government\u2019s failure to submit the documents from  the investigation files which were in their exclusive possession or  to provide another plausible explanation for the events in question.  Noting in the cases of <span class=\"Normal--Char\" style=\"font-weight: bold; font-style: italic;\">Dzhambekova and Others<\/span> and <span class=\"Normal--Char\" style=\"font-weight: bold; font-style: italic;\">Khadayeva and Others <\/span>that the authorities  had not justified the use of lethal force by their agents and in the  case of <span class=\"Normal--Char\" style=\"font-weight: bold; font-style: italic;\">Elsiyev and Others<\/span> that the Government had failed to give any  plausible explanation for the events in question, the Court concluded  that there had been a violation of Article 2 in respect of all of the  applicants\u2019 relatives.<\/span><\/p>\n<p class=\"Normal\" style=\"margin-top: 12pt; text-align: justify;\"><span style=\"color: #000000;\">In all three cases, the  Court further held that there had been violations of Article\u00a02 relating  to the authorities\u2019 failure to carry out effective investigations  into the circumstances in which the applicants\u2019 relatives had disappeared.<\/span><\/p>\n<p class=\"Normal\" style=\"margin-top: 12pt; text-align: justify;\"><span style=\"color: #000000;\">The Court also found that,  with the exception of Magomed Soltymuradov\u2019s uncle and cousin who  could not be considered as his close family members and had not apparently  been involved in the search for him, all the applicants had suffered  and continued to suffer distress and anguish as a result of the disappearance  of their relatives and their inability to find out what had happened  to them. The manner in which their complaints had been dealt with by  the authorities had to be considered to constitute inhuman treatment,  in violation of Article\u00a03.<\/span><\/p>\n<p class=\"Normal\" style=\"margin-top: 12pt; text-align: justify;\"><span style=\"color: #000000;\">The Court found in particular  in all three cases that the applicants\u2019 relatives had been held in  unacknowledged detention without any of the safeguards contained in  Article\u00a05, which constituted a particularly grave violation of the right  to liberty and security enshrined in that article.<\/span><\/p>\n<p class=\"Normal\" style=\"margin-top: 12pt; text-align: justify;\"><span style=\"color: #000000;\">Lastly, the Court found  that, in the case of <span class=\"Normal--Char\" style=\"font-weight: bold; font-style: italic;\">Dzhambekova and Others<\/span>, Imran Dzhambekov\u2019s  mother and Magomed Soltymuradov\u2019s sister had been detained for fours  days in December 2002 in manifest contradiction to the procedural guarantees  provided for by domestic legislation and the European Convention, in  violation of Article 5 \u00a7 1. It further held that the mental anguish  caused by the unlawful nature of their detention had been exacerbated  by the unsatisfactory conditions of their detention, especially taking  into account the two women\u2019s vulnerable position, in view of their  age, 43 and 53 at the time, and gender. The Court therefore held that  there had been a violation of Article 3 on account of the two women\u2019s  conditions of detention in December 2002.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The ECHR cases of Dzhambekova and Others v.
